The website greecevest.gr (hereinafter the “website” or the “site”) constitutes an online platform dedicated to the real estate sector, through which its users are able to search for and select the professional they wish, among various specialties related to real estate, as well as to access property listings posted on the website by certified real estate agencies.

This document (hereinafter the “Terms of Use”) includes all terms and conditions governing the relationship between GREECEVEST and you (hereinafter the “User,” “you,” “your”) regarding your navigation on the website and your use of the provided services.
 Please read these Terms of Use carefully, as well as the Privacy Policy, before starting to use the site. Your registration on our website and use of its services implies your unconditional acceptance of this Agreement and the site’s Privacy Policy, as applicable from time to time.

MINORS

 Use of the website and of the services provided on it is permitted exclusively to Users who have completed their 18th year of age. By accepting the Terms of Use, the User declares that he/she is an adult, over 18 years old, or, if he/she is under 18 years old, that he/she has obtained the necessary consent from all those having parental responsibility for him/her and that he/she will provide their details, if such is requested of him/her. We reserve the right to take all reasonable technical measures and to prohibit access to the website to any User, in the event that we establish a breach of this term.

Users who wish to have access to the services of GREECEVEST must create their account on the website, filling in certain necessary details which will be requested from them for their identification.

The registration of the User on the website and the use of the services provided is carried out free of charge, without any burden.

 The website constitutes an online space for the display of properties that are available for sale or rent, as well as for the search and finding of professionals of various specialties, whose services the User needs for the acquisition, renovation, maintenance, or sale of a property. Indicatively, on our website one can find professionals of the following specialties:

• Engineers
• Technicians
• Lawyers
• Notaries
• Property management companies
• Maintenance and cleaning companies

The User, once he/she locates the property or the professional that interests him/her, will have the possibility to contact them at their contact details which are available on the website. Communication with the professional and/or the expression of interest in a property, as well as any further negotiation or conclusion of an agreement, is left exclusively to the User and to the professional, without any participation of GREECEVEST in the relevant process. 

PERMITTED USE

Users must use the website and the services provided on it in a lawful and fair manner, behave with honesty and respect, and contribute to the smooth operation of the website. In this context, the following are prohibited to Users and constitute a breach of these Terms of Use:

a) the use of the website and/or the services in a way that could damage, alter, or destroy the website or part of it and/or impede access to or use of it by other Users,

b) the use and/or distribution on the website of any malicious or non-malicious software, and/or the sending of harmful files, capable of endangering the smooth operation and/or integrity of the website and/or the connection and access of other Users to it,

c) the publication, sending, or other means of communication on the website or through it of any offensive, harassing, vulgar, racist, aggressive, pornographic, defamatory, or generally illegal content,

d) the publication, sending, or other means of communication on the website or through it of content that they are not entitled to communicate, such as, for example, information of third parties for which there is a confidentiality obligation,

f) the abusive use of the services provided, such as, for example, the scheduling of appointments that they do not intend to keep,

g) the creation of multiple accounts on the website with fraudulent intentions,

h) access or attempted access to accounts of other Users and/or unlawful access to data of other Users,

i) the infringement of rights of GREECEVEST, of other Users of the website, or of third parties, such as indicatively their personal data or intellectual property rights,

j) access to the website for purposes of comparative analysis, copying, reverse engineering, or with other competitive intentions,

k) the use of the website with the aim of circumventing the applicable legislative and regulatory framework and/or achieving any illegal, unfair, or immoral purpose,

l) any other use of the website which is in conflict with these Terms of Use and the applicable laws and regulations, as well as the encouragement, facilitation, or collusion with any third party for the commission of the prohibited acts and omissions referred to herein.

 GREECEVEST reserves the right, in the event that it establishes or suspects any breach of these Terms of Use, to remove from the website any false, illegal, immoral, or offensive content, to temporarily suspend or permanently delete the account of the breaching User, without cost for GREECEVEST and without prior notice, to transmit any information it deems necessary to the competent Authorities, without the consent of the User, as well as to seek satisfaction for any damage suffered by it arising from the relevant breach by taking any available judicial or extrajudicial measure. 

THIRD-PARTY WEBSITES

 The website may provide links that redirect to third-party websites or social media, such as, for example, those of the professionals displayed on the website. In no case should GREECEVEST be considered as adopting or accepting the content, or as recommending the products or services of the said pages to which it refers, or as guaranteeing their security, validity, and integrity, or as being connected to them or their administrators in any way. Access to and use of these websites is at the exclusive responsibility of the User and is subject to the terms of use and policies referred to there. 

SECURITY AND FUNCTIONALITY

We make every effort in order to continuously improve the experience of Users who visit our website. However, due to the nature of the internet, we cannot guarantee or ensure that use of the website will be uninterrupted, secure, or error-free. In any case, GREECEVEST reserves the right at any time to temporarily or permanently discontinue the operation of the entire website or part of it, for reasons of maintenance, or upgrade, or for any other reason.

Also, despite the security measures maintained, we cannot ensure the inviolability of the website from digital viruses, malicious software, or any other kind of harmful or destructive files or programs, which impede the operation of the website and/or have as a consequence the damage of the website and/or of its Users. The User is exclusively responsible for the trust he/she places in the information contained on the website and for taking any decision based on them.

“GREECEVEST” constitutes our registered trademark (OBI filing no. N294421) and enjoys the full protection provided for by the relevant legislation. In addition, with the exception of intellectual property rights of third parties (such as displayed professionals, partners, and bodies) for which GREECEVEST has received special permission for their use on the website and for the purposes thereof, all the content of the website, including images, graphics, photographs, designs, compositions, texts, services provided, as well as the software, constitute intellectual property, registered trademarks, or distinctive signs of GREECEVEST and are protected by the relevant provisions of Greek law, European law, and international conventions and treaties.

The User understands and accepts that he/she is granted no right to reproduce, download, copy, modify, sell, resell, process, and/or commercially exploit, in any way, all or part of the content of the website, without the prior consent of GREECEVEST.

INDEMNIFICATION

 You agree to indemnify, defend, and restore any damage of GREECEVEST, of any parent or subsidiary company of ours, of our officers, directors, employees, and/or partners, against any claim or demand of a third party, including reasonable attorneys’ fees, that is submitted by any third party, due to or on the occasion of your breach of these Terms of Use, of the Personal Data Protection Statement and/or of any applicable law, regulation, or code of conduct. 

LIMITATION OF LIABILITY

 All professionals displayed on the website have gone through a process of verification of their training, specialization, and ability to provide their offered services. However, the User understands and accepts that GREECEVEST – to the maximum extent permitted by law – is not obliged and is not always in a position to investigate the completeness, suitability, and validity of the information provided and disclaims any relevant liability. If you point out errors, inaccurate, or false information, we kindly ask you to inform us without delay and every reasonable effort will be made on our part for their restoration to the extent possible. 

You understand and accept that the website constitutes merely an online place for indexing, display, and promotion of properties and professionals. In no case can the display of a professional on the website be understood as concealing any legal or other connection of GREECEVEST with that professional, nor as constituting an encouragement or advice or mediation on the part of GREECEVEST for the conclusion of any agreement with him/her, nor as rendering GREECEVEST a contracting party in the relationship between User and professional. Correspondingly, the properties displayed on the website are posted by certified agents who have been assigned the mediation for their sale, and no legal or other relationship exists between GREECEVEST and each respective owner or agent. 

 The User and each professional or agent displayed on the website are absolutely free to negotiate and agree on the terms of any potential cooperation between them, and any such negotiation takes place outside the website, without the mediation of GREECEVEST and at the exclusive discretion and responsibility of the User. 

 Therefore, you expressly acknowledge that any agreement of yours for a property or any agreement of yours with a professional displayed on the website for the provision of his/her services to you in no case binds GREECEVEST, which bears no responsibility for any claims in relation to any act, omission, or breach on the part of the professional, either at the time of the conclusion of your agreement or during the performance of the relevant services. 

To the maximum extent permitted by law and unless otherwise specified in these Terms of Use, GREECEVEST expressly disclaims and denies any liability regarding:

To the maximum degree permitted by law, and unless otherwise provided in these Terms of Use, GREECEVEST disclaims and expressly denies any liability of it with regard to:

a) any breach on the part of the professionals displayed on the website of any applicable legislation and/or code of professional conduct,

b) any injury, damage, deterioration of health, or death that is connected in any way, directly or indirectly, with the content of the website, the services provided through it, and/or the services of the professionals displayed on it,

c) any damage, direct or indirect, including lost profits, that in any way arises from or is connected to the content of the website, the services provided through it, and/or the services of the professionals displayed on it,

d) any damage, loss of revenue, or profits that arises from the temporary unavailability of the website, or from the unsuccessful provision of our services due to an error, omission, interruption, delay in the operation or transmission of the website,

e) any damage, harm, deterioration of property, loss or leakage of data, leakage of passwords, loss of confidential information, or breach of the confidentiality of communication, that in any way is connected with the use of the website, to the extent that the above cannot be attributed to intent or gross negligence of GREECEVEST,

f) any damage, harm, deterioration of property, loss or leakage of data, leakage of passwords, loss of confidential information, or breach of the confidentiality of communication, that arises from or is connected with the User’s access to third-party websites or social media to which the website redirects via relevant hyperlinks,

g) any infringement of intellectual property rights that are embedded in the website, by any User of the website or third party.

DURATION AND TERMINATION

These Terms of Use automatically enter into force upon the visit of any User to the website, remain in force throughout the duration of access to the website and/or use of the services provided, and constitute a fully binding legal agreement between GREECEVEST and each User.

GREECEVEST reserves the right, at any time, without prior notice, to terminate this agreement and to suspend and/or discontinue the provision of its services to the User, in the event that it establishes or reasonably suspects a breach on his/her part of these Terms of Use, without prejudice to the exercise of any other right of GREECEVEST against the User, in accordance with the provisions of the Law.

GREECEVEST also has the right at any time, at its discretion, to discontinue the operation of the website, without prior notice, in which case this agreement shall be automatically terminated.

In the event that the User wishes to delete his/her account on the website, he/she may do so at any time by selecting the corresponding option through his/her account. These Terms of Use will, however, remain in force, as long as he/she continues to access the website as a simple visitor.

 APPLICABLE LAW AND JURISDICTION 

 These Terms of Use are governed by and interpreted in accordance with the laws of Greece, with the exception of the provisions on conflict of jurisdictions. The courts of Corfu that have subject-matter jurisdiction are designated as the locally competent courts for the resolution of any dispute that may arise between you and GREECEVEST. 

 PARTIAL INVALIDITY 

 In the event that any provision of these Terms of Use is found to be illegal, invalid, or unenforceable, that provision shall be enforceable to the maximum extent permitted by applicable law, and the invalid part thereof shall be deemed not to form part of these Terms of Use. This characterization shall not affect the validity and enforceability of the remaining provisions of the present. 

NO WAIVER

 The omission or delay on the part of GREECEVEST to enforce any provision of these Terms of Use and/or to exercise any of its rights shall not be interpreted as a waiver of any such provision or right. 

SPECIAL TERMS

 In the event that the use of any service of the website is governed by more specific terms, those terms shall be considered as a single whole together with these Terms of Use. However, in the event of conflict, the more specific terms of use of each individual service shall prevail. 

 MODIFICATION 

 GREECEVEST reserves the right, at any time, to modify these Terms of Use. Continued access to the website and use of its services shall be understood as unconditional acceptance of the relevant changes by the User. For this reason, Users are advised to visit this page at regular intervals during their use of the services provided. The date of the last modification of the Terms of Use will always appear at the top of this page.
